This document describes our Privacy Policy. Our privacy policy is designed to advise you about how we collect, use, and protect the personal information you provide. By registration or by usage of the CivicPoints website and/or mobile application, you agree and accept this Privacy Policy. Unless otherwise provided, any terms used in this Policy shall have the meaning set forth in the Terms of Service.
WHAT INFORMATION IS COLLECTED
1. Information You Provide to Us: We collect any information you enter through the CivicPoints website or mobile application or otherwise provide to us through your use of the Services. You can choose not to provide certain information, but you may not be able to take advantage of our services and features.
2. Information Automatically Provided. When you visit the CivicPoints website or access the mobile application, your device discloses certain information, such as your IP address, operating system, and the time of your visit. We also use Cookies and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your use of the Services.
3. Geolocation Data. Inherent to the Services is your “checking in” at certain events and/or locations as designated by a Community Organization. In order for these core Services to operate and in order to serve you and the Community Organization, we may use GPS technology or other geo-location services and data to determine your precise geographic location. We may use and store information about your location to provide features of our Services and to improve and customize it. Also, we may use it for statistics analysis and share that non-personal aggregated data with other parties. We will not use or share this data for any other purpose. Many devices will show you an icon when location services are operating. We only share this location information with others as approved by you. If you do not want us to use your location for the purposes set forth above, you should switch off the GPS tracking device or turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application; provided, however, that disabling location tracking on your device may render you unable to access or use some or all Services.
All information described above, “Information”.
We may collect, use, and share aggregated data (statistical or demographic data) for any purpose. Although this data is derived from end-users’ personal data, it cannot directly or indirectly lead to an end-user’s identity in aggregated form and is therefore not “personal data” for purposes of this Privacy Policy. If the aggregated data is connected to end-users’ personal data such that end-users can be identified, we will treat that data as personal data for purposes of this Privacy Policy.
How Your Information Is Used
CivicPoints may also use your personal data for a variety of business purposes, as described in detail below in furtherance of its legitimate business interests. We may use the Information in order to:
Authenticate your use of the Services and enable the sending of alerts, scrolling tickers, surveys, and other content;
Provide you the full suite of available Services, including to facilitate contests, sweepstakes and promotions and process and deliver entries and rewards;
carry out our obligations arising from any contracts entered into between you and us;
comply with any legal obligations to which we are subject;
where it is necessary to carry out our or a third party’s legitimate interests except where users’ interests or fundamental rights and freedoms override these interests;
send marketing communications to user regarding requested information, purchased services, and promotions in which the user has participated, unless they have opted out of receiving such communications. While users may opt out of marketing messages, they will continue to receive necessary service-related communications regarding their accounts, product experiences, or other transactions;
deliver relevant Service-related content and advertisements to end-users and measure or understand the effectiveness of this advertising;
respond to legal requests and prevent harm. For example, if CivicPoints receives a subpoena or other legal request, we may need to inspect the personal data it holds in order to determine if and how to respond; and
administer, protect, and improve the Services through data analysis, testing, system maintenance, troubleshooting, reporting and hosting.
How Your Information Is Shared
We only share personal data with your consent, to comply with laws, to protect your rights, or to fulfill business obligations. As a non-exclusive list of examples, CivicPoints only shares and discloses your personal data in the following situations:
Compliance with Laws. We may disclose your personal data where legally required to do so in order to comply with applicable law, governmental requests, or a judicial proceeding, court order, or legal process such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements);
Vital Interests and Legal Rights. CivicPoints may disclose your personal data where it believes it is necessary to investigate, prevent, or take action regarding potential violations of Our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or in the event of litigation;
Vendors, Consultants and Other Third-Party Service Providers. We may share your personal data with third party vendors, service providers, contractors or agents (“Third-Party Processors”) who perform services on its behalf and require access to such information. For example, we may use third parties for technical and customer support, messaging, payment processing, data analysis, email delivery, hosting services, customer service, and marketing efforts. These service providers include Tangocard (for administration of “rewards” relating to your usage of the Services), OpenStreets (for mapping), Twilio (for messaging services), Loops.io (for email notifications and verifications), Microsoft Azure Blob Storage (for image and attachment storage), Google (for sign-ins), Apple (for sign-ins), and Firebase (for notifications and session tracking). Their respective privacy policies are, to the extent applicable to your usage of the Services, incorporated by reference.
Business Transfers. CivicPoints may share or transfer your personal data in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of its business to another company.
Business Partners. CivicPoints may share your personal data with its business partners to offer you certain products, Services or promotions, and/or to facilitate provision of CivicPoints products and Services to you, as well as with other CivicPoints entities; and
With your Consent. CivicPoints may disclose your personal data for any other purpose in accordance with your consent.
Your Choices Regarding Marketing
When you sign up for a promotion or subscribe for the Services, we use your personal information to inform which products and services to offer to you. We may send marketing messages to you if you have requested such information, made a purchase from us, or shared your personal information when registering for a promotion. If you opt not to receive marketing messages, we may still send you non-promotional emails, such as those about your subscription to the Service. We will ask for your consent before we share your personal information with any third party for direct marketing purposes.

These measures include, but are not limited to, encryption, access controls, secure data storage, regular security assessments, and employee training on data protection.
CivicPoints has implemented appropriate technical and organizational security measures designed to protect the security of any personal data it processes. However, please also remember that CivicPoints cannot guarantee that the internet itself is 100% secure. Although CivicPoints will do its best to protect your personal data, transmission of personal data to and from the Services is at your own risk. You should only access the Services within a secure environment. We have implemented procedures to deal with any suspected personal data breach and will notify end-users and any applicable regulator of a breach where we are legally required to do so.
How long we will keep your Information
We keep your Information for as long as we need to provide the Services to you and fulfill the purposes set out in this Privacy Policy. This is also the case for anyone that we share your information with and who carry out services on our behalf.
The primary factors we consider in determining retention periods can include minimum requirements under applicable law, relevant industry standards, the types of data in question (such as its level of sensitivity), relevance to potential litigation or similar proceedings (such as defending ourselves against legal claims), and whether the Information is required to prevent fraud or similar abuse of the Services. When we no longer need to use your Information and there is no need for us to keep it to comply with our legal or regulatory obligations, we will either remove it from our systems or anonymize it so that it can no longer be associated with you. When removing Information, we will take commercially reasonable and technically feasible measures to make said Information irrecoverable or irreproducible.
Minors
CivicPoints strictly prohibits and does not knowingly collect personal data from or market to children under 18 years of age .By using the Apps and/or the Websites, you represent that you are at least 18 or that you are the parent or legal guardian of such a minor and consent to such minor dependent’s use of the Apps and the Websites. If CivicPoints learns that personal data from users less than 18 years of age has been collected, it will deactivate the account and take reasonable measures to promptly delete such data from CivicPoints’s records. The Apps, the Websites, and Services are not directed at children under 13 years of age and, therefore, COPPA does not apply. However, we recognize that children under the age of 13 may potentially access the Apps, the Websites, and Services. The collection of information is covered above. Parents and Legal Guardians may request from us to review, delete or stop the collection of the personally identifiable information of their child. We reserve the right, at any time and without notice, to add to, change, update or modify this Privacy Policy, by posting such change, update or modification on the Site. Any such change, update or modification will be effective immediately upon posting.
